Questions about separation agreements

How long do I need to be separated?

For a final divorce based on separation, Virginia generally requires one year of living separate and apart without cohabitation and without interruption. A six-month alternative applies when you have a separation agreement and no minor children born to both spouses, born to one and adopted by the other, or adopted by both. These periods do not include the additional time needed to complete the court process.

Can I get help before the separation period ends?

Yes. You can get advice, negotiate terms, and address financial or parenting concerns while separated. Depending on your circumstances, court proceedings may also be available before you qualify for a final divorce. Will I have to appear in court?

Not every divorce requires an in-person hearing. Some qualifying no-fault cases can proceed using written sworn statements called affidavits.
